Welcome to musclebeach.com (the "Site"). These Terms of Service ("Terms") are a legal agreement between you and Muscle Beach, LLC ("Muscle Beach," "we," "us," or "our") that governs your access to and use of the Site, including any purchases of apparel, accessories, dietary supplements, or other products you make through the Site.

By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us immediately at info@musclebeach.com if you suspect unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

4. Purchases and Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion, including in cases of:

  • Suspected fraud or unauthorized payment activity
  • Pricing or product description errors
  • Inventory limitations
  • Inability to verify your identity or shipping address
  • Violations of these Terms

If we decline your order after payment has been processed, we will issue a full refund.

Pricing. All prices are in U.S. dollars and exclude applicable taxes and shipping unless stated otherwise. We work to keep pricing accurate, but errors can occur. If a product is listed at an incorrect price, we may cancel your order or contact you for instructions before shipping.

Payment. Payment is processed at checkout through our payment providers (including Shopify Payments). You agree to provide accurate payment information and authorize us to charge the payment method you select.

Order confirmation. A confirmation email is not an acceptance of your order. Your order is accepted when we ship the product.

5. Shipping and Returns

Shipping rates, delivery times, and return policies are described in our Shipping Policy and Refund Policy, which are incorporated into these Terms by reference. Please review them before placing an order.

6. Product Information

We work to display product colors, sizes, and details as accurately as possible. However, actual products may vary slightly from images shown on the Site due to factors like screen settings, photography, and manufacturing variations. Product availability is not guaranteed and may change without notice.

7. Dietary Supplements and Health Disclaimers

Some products sold on the Site are dietary supplements. The following applies to all supplement products:

FDA disclaimer. Statements regarding dietary supplements have not been evaluated by the Food and Drug Administration. Our supplements are not intended to diagnose, treat, cure, or prevent any disease.

Our total liability to you for any claim arising from or related to these Terms or your use of the Site will not exceed the amount you paid to us for the product or service giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of these limitations may not apply to you. In those cases, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold Muscle Beach LLC and its officers, directors, employees, and affiliates harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any law or third-party right
  • Any content you submit to the Site

16. Dispute Resolution

Informal resolution first. Before filing a formal claim, please contact us at info@musclebeach.com so we can try to resolve the issue directly. Most disputes can be resolved this way.

Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Venue. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

No class actions. You and Muscle Beach agree to bring claims against each other only in an individual capacity and not as part of any class or representative action.

17. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

18. International Visitors

The Site is operated from the United States and intended for U.S. customers. We make no representation that products or content are appropriate or available outside the U.S. If you access the Site from another country, you do so at your own initiative and are responsible for compliance with local laws.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the "Last updated" date at the top. Material changes will be communicated through the Site or by email when appropriate. Your continued use of the Site after changes are posted means you accept the updated Terms.

20. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the complete agreement between you and Muscle Beach concerning the Site.

Severability. If any part of these Terms is found unenforceable, the rest will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to any successor or affiliate.

Electronic communications. By using the Site, you consent to receive communications from us electronically (by email or by posting on the Site), and you agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that they be in writing.
